I’m being threatened with litigation on a 17 yr old debt

Facing Legal Threats Over a 17-Year-Old Debt: What to Know and How to Respond

Today, I received an unexpected call that threw me into a whirlwind of confusion and concern. The caller claimed that someone was preparing to initiate legal action against me, but they wanted to discuss matters before proceeding with the lawsuit. The whole situation felt suspicious, prompting me to follow up by calling the number they provided.

Upon making contact, my suspicions grew. The individual on the other end was reluctant to identify their law firm and insisted that I agree to a payment plan before they would provide any documents validating the debt. Naturally, I was hesitant to commit to anything without evidence in hand, as I intended to review any claims with my attorney first. However, she asserted that since I hadn’t previously disputed the debt, it was considered valid, and acquiring the necessary documents would require my attorney to issue a subpoena.

In an attempt to gather more information, I asked for a case number and the jurisdiction where the suit was allegedly being filed. Yet again, she insisted that my attorney would need to handle that inquiry. The alleged debt dated back to a mobile phone company I haven’t been associated with for approximately 17 years. To my knowledge, the statute of limitations in Oklahoma for such cases is around 5 or 6 years. Despite this, I had received no prior communication or collection attempts concerning this debt until today.

To add to the confusion, I was later presented with another option: I could obtain the paperwork by agreeing to a payment plan and beginning to make payments. This offer only deepened my skepticism about the legitimacy of the situation.

For anyone encountering a similar scenario, it’s vital to remain cautious and seek legal advice. Verify all claims independently and understand your rights, particularly regarding the statute of limitations in your jurisdiction. Engaging in any payment arrangement without documentation could complicate your situation further. Always consult with a legal professional to navigate these challenging circumstances safely and effectively.
