Urgent Advice Needed: Neighbor Claims Rights to Demolish Our Home
This morning, my wife reached out in a state of distress, and I’m still reeling from the news. Our neighbor has moved in heavy yellow demolition equipment onto our property, uprooted our hedges, destroyed our garden shed, and is now approaching our garage and house. Meanwhile, I’m hundreds of miles away for work, stuck at a service station after a long drive.
In her panic, my wife contacted the police, but they informed her that this is a civil matter and advised her to seek legal help.
We purchased our detached house two years ago with a mortgage from a reputable bank, and the property’s deeds are undoubtedly in our name. However, when we bought the home, we learned that the neighbor had previously secured planning permission to demolish our house to make way for an annex. Our solicitor—who has since passed away and whose firm has closed—confirmed that this was merely an application. The neighbor had expressed interest in buying our home but ultimately did not proceed with the purchase.
In an effort to resolve the situation, I tried to speak with the neighbor. Unfortunately, there were some language barriers, but he firmly believes that the planning permission grants him the right to demolish our property. He seems to misunderstand that planning permission does not equate to ownership.
Now, I’m at a loss for how to proceed, especially since I’m so far from home. I have reached out to multiple solicitors for guidance, but I haven’t received any calls back yet.
As we navigate this harrowing situation in England, I’m seeking any advice or insights from those who may have faced a similar predicament. What steps should we take to protect our home and rights? Your guidance would be greatly appreciated.
