Im being sued for a debt that no longer exists

Facing a Lawsuit for a Non-Existent Debt: A Personal Encounter with Debt Collection Practices

Introduction

Navigating the maze of post-bankruptcy life can bring unexpected challenges, especially when dealing with persistent debt collectors. My journey through this legal labyrinth began with a mortgage, which had been discharged in bankruptcy court, only to become ensnared once again in the grips of relentless pursuit.

The Ongoing Struggle

Eight years ago, my mortgage was officially discharged. Despite this, the firm Cenlar continued to bombard me with invoices, demanding payment for a debt I no longer owed—an amount exceeding $200K, inflated with added fees and costs. The original sum was nowhere near this figure, and the irony was, I no longer possessed the property in question.

Communicating this was a herculean task. Despite informing their representatives, emailing, mailing, and even faxing my discharge documentation, the harassment persisted. The only course of action left was to sue them, and in 2023, justice was served in my favor.

The Battle Against Legal Bullying

The expectation was simple: having won the case, the lawsuit against me would cease. However, to my bewilderment, the law firm, Tromberg, Morris & Poulin, continued to pursue the claim, even adding their legal fees to the mounting calamity. My lawyer, whom I had hoped to bid farewell, now must be involved yet again.

The process is infuriating. It seems these enormous debt collection companies thrive on intimidating consumers with unfounded claims. They wield the legal system like a weapon, aiming to silence us through sheer force of intimidation. Yet, our resources to combat this are woefully limited.

A Call for Change

It’s disheartening to find myself up against Tromberg, Morris & Poulin, a firm already fined by the state of New York for deceptive practices, and still, they persist elsewhere. My original lender, Citimortgage, too has faced similar accusations. Standing alone in this complex fight often leaves me feeling powerless.

Conclusion

My story is just one of many that highlight the struggles faced by consumers against powerful debt collection entities. This experience underscores the urgent need for systemic reforms to better protect individuals from such dubious practices. Through this blog, I hope to inspire others in similar situations to persist in their fight for justice and hold these companies accountable.
